1. COMPANY INFORMATION
Excursions Barcelona is the trading name of Events Barcino S.L., a company incorporated under Spanish law.
Events Barcino S.L. operates outdoor and adventure activities (actividades de aire libre) and holds all legally required insurance policies in accordance with applicable Spanish regulations.
2. SCOPE OF SERVICES
Events Barcino S.L. provides guided outdoor and adventure experiences including kayaking, snorkeling, hiking, cliff jumping, sailing and related recreational activities.
Where applicable, the Company may provide complimentary transport strictly as an accessory and non-separable element of the booked activity, solely for transferring participants between the designated meeting point (our business office address) and the activity location.
Such transport:
• Is not offered independently
• Is not separately charged
• Is exclusively available to confirmed participants
• Is ancillary to the outdoor activity
For certain private tours, hotel transfers may be arranged through licensed third-party transport providers or taxis.
Events Barcino S.L. does not operate as a public transport provider.
The Company reserves the right to modify itineraries where necessary for operational or safety reasons.
3. CONTRACTUAL RELATIONSHIPS
3.1 Direct Website Bookings
For bookings made via the official website, the contract is concluded directly between the participant and Events Barcino S.L. upon successful payment and confirmation.
Acceptance of these Terms is mandatory before payment.
3.2 Third-Party Platforms (OTAs)
Where bookings are made via third-party platforms (including but not limited to GetYourGuide, Viator, Airbnb Experiences and similar platforms):
• The contractual relationship between the participant and the platform is governed by that platform’s terms.
• Events Barcino S.L. acts as the operational activity provider delivering the experience as contracted with the platform.
• Pricing, payment processing and commercial conditions are determined by the platform.
Participation in the activity constitutes acceptance of the operational rules and safety requirements of Events Barcino S.L.
3.3 Agency Bookings (B2B)
Agencies act as independent intermediaries unless otherwise agreed in writing.
Agencies are responsible for ensuring clients:
• Meet swimming requirements
• Meet minimum age requirements
• Disclose medical conditions
• Accept cancellation terms
• Understand participation risks
Agencies indemnify Events Barcino S.L. against claims arising from failure to properly inform clients.
4. PRICING & VAT
All website prices include applicable Spanish VAT under the general VAT regime.
For bookings via third-party platforms or agencies, pricing and invoicing arrangements are governed by the respective commercial agreement.
5. CANCELLATION POLICY
Public Tours
• Free cancellation up to 24 hours before the activity
• Within 24 hours: non-refundable
Private Tours
• Free cancellation up to 7 days before the activity
• Within 7 days: non-refundable
6. WEATHER & FORCE MAJEURE
Events Barcino S.L. reserves the right to cancel or modify activities due to:
• Unsafe sea or weather conditions
• Storms or high waves
• Political or transport disruptions
• Government restrictions
• Force majeure events beyond reasonable control
In such cases, clients will be offered:
• Full refund
• Rescheduling (subject to availability)
• Alternative non-water-based activity (subject to availability)
7. NO-SHOW & LATE ARRIVAL
Failure to arrive at the designated meeting point at the specified time shall be treated as a no-show.
The activity will proceed as scheduled.
No refund or rescheduling will be granted.
We do not take responsibilities for 3rd parties such as now-show taxis / Ubers etc.
8. PARTICIPATION REQUIREMENTS
Minimum Age
Minimum age: 7 years.
Participants under 16 must be accompanied by a parent or legal guardian.
Swimming Ability
Competent swimming ability is mandatory for all sea-based activities.
Non-swimmers will not be permitted to participate and no refund will be issued.
Health & Medical Conditions
Participants are responsible for ensuring they are physically and mentally fit.
Any medical condition that may affect participation must be disclosed in advance.
Pregnant participants or those with medical conditions must obtain written medical clearance.
Failure to disclose relevant conditions releases Events Barcino S.L. from liability related to undisclosed risks.
9. SAFETY & CONDUCT
Participants must:
• Follow guide instructions
• Respect safety protocols
• Behave responsibly
The Company reserves the right to exclude any participant:
• Under the influence of alcohol or drugs
• Acting recklessly
• Failing to follow instructions
No refund will be granted in such cases.
10. ASSUMPTION OF RISK
Adventure and outdoor activities involve inherent risks including but not limited to:
• Slips and falls
• Contact with rocks
• Sea conditions
• Equipment-related risks
• Physical exertion
By participating, individuals acknowledge and voluntarily accept these inherent risks.
11. EQUIPMENT USE & RESPONSIBILITY
Equipment used during activities may be provided by Events Barcino S.L. and/or its partners
All equipment remains under the control and responsibility of Events Barcino S.L. and/or its partners.
Participants are responsible for:
• Proper use of equipment
• Following handling instructions
• Returning equipment in the condition received
Participants shall be financially responsible for damage, loss, or destruction of equipment resulting from negligence, misuse, reckless conduct, or failure to follow instructions.
Standard replacement charges include:
• Lost snorkel mask and snorkel set: €20
• Other equipment: repair or replacement cost as reasonably determined
Normal wear and tear from proper use is excluded.
Events Barcino S.L. reserves the right to charge the responsible participant accordingly where legally permitted.
12. LIABILITY LIMITATION
To the maximum extent permitted by Spanish law:
• Liability is limited to the total amount paid for the booking.
• No liability is assumed for indirect or consequential damages.
• No responsibility is accepted for personal belongings.
• No liability arises from participant negligence or failure to follow instructions.
Nothing excludes liability where exclusion is prohibited by law.

14. MARKETING & IMAGE RIGHTS
Photos and videos may be taken during activities for promotional purposes.
Participants may object at any time by informing staff.
Images may be used on websites and social media without compensation.
15. COOKIES
The website uses:

• Marketing cookies (e.g., Facebook Pixel)
Users may manage preferences via the cookie banner.
16. DATA SUBJECT RIGHTS
Participants may exercise rights of:

Complaints may be filed with the Spanish Data Protection Authority (AEPD).
17. DISPUTE RESOLUTION
Parties agree to attempt amicable resolution prior to legal action.

18. GOVERNING LAW
These Terms are governed by Spanish law.
Jurisdiction: Courts of Barcelona, Spain.
